1. Agreement to Terms

By creating a ZenView account or using the Software, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not install or use ZenView.

2. Eligibility

You must be at least 18 years old to use ZenView. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement.

3. License Grant

Subject to your compliance with these Terms, ZenView grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software on devices you own or control for your personal, non-commercial use.

You may NOT:

• Resell, sublicense, or distribute ZenView
• Reverse engineer, decompile, or disassemble the Software
• Remove or modify any proprietary notices
• Use ZenView for any illegal purpose or in violation of any laws
• Bypass, disable, or interfere with security features or the Software's functionality
• Use ZenView to monitor others without their knowledge and consent

4. How ZenView Works

ZenView uses AI-powered computer vision to detect explicit imagery on your device in real-time. All processing happens on your device—no screenshots or content are sent to ZenView servers.

Important Limitations:

• AI is not perfect. ZenView may make detection mistakes, including false positives (blocking non-explicit content) and false negatives (failing to block explicit content).
• Not 100% effective. No blocking software provides 100% protection. Determined users can find ways to bypass any blocker.
• Your responsibility. ZenView is a tool to support your recovery journey. It is not a substitute for therapy, support groups, or personal accountability.

You acknowledge that ZenView's effectiveness depends on proper installation, configuration, and your commitment to your recovery goals.

5. Account and Subscription

5.1 Account Creation

You must provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

5.2 Subscription Plans

ZenView is offered as a monthly or annual subscription service. By subscribing, you authorize ZenView to charge your payment method on a recurring basis until you cancel.

5.3 Pricing

Current pricing is available at zenview.app. We reserve the right to change our prices with 30 days' notice to active subscribers. Price changes will not affect your current subscription period.

5.4 Payment Processing

We use third-party payment processors (Stripe) to handle billing. We do not store your payment card information. Your payment information is subject to the payment processor's terms and privacy policy.

5.5 Auto-Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged at the then-current subscription rate.

6. Cancellation and Refunds

6.1 Cancellation

You may cancel your subscription at any time through your account settings or by contacting support@zenview.app. Cancellation will be effective at the end of your current billing period. You will retain access to ZenView until that date.

Uninstalling the Software does NOT cancel your subscription.

6.2 Refund Policy

14-Day Money-Back Guarantee:

If you cancel within 14 days of your initial purchase, you will receive a full refund. To request a refund, contact support@zenview.app.

After 14 Days:

All fees are non-refundable for partial subscription periods or unused time.

Important Notes:

• This 14-day period applies to your first purchase only. Subscription renewals are non-refundable.
• Refunds are processed within 5-10 business days to your original payment method.
• For EU customers, this satisfies your statutory 14-day right of withdrawal under EU Consumer Rights Directive.

7. Privacy and Data Collection

ZenView is committed to protecting your privacy:

• All content detection happens on your device
• We do not collect, store, or transmit screenshots or browsing data
• We collect only minimal data necessary to operate the Service (account info, subscription status, basic usage analytics)

Our complete data practices are described in our Privacy Policy, which is incorporated into these Terms by reference.

8. System Access and Permissions

To function properly, ZenView requires elevated system permissions on your device, including:

• Screen recording/accessibility permissions
• Window management access
• Network monitoring capabilities

By installing ZenView, you grant these permissions and acknowledge that:

• ZenView operates at a system level to perform its core function
• You understand the technical implications of granting these permissions
• You are installing ZenView on a device you own or have authorization to modify

9. Software Updates

We may release updates, patches, or new versions of ZenView. Some updates may be installed automatically. You agree to receive and install updates as they become available. Failure to update may result in reduced functionality or security vulnerabilities.

10. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. ZenView may be temporarily unavailable due to:

• Scheduled maintenance
• Technical issues beyond our control
• Security incidents
• Force majeure events

We are not liable for any disruptions to the Service.

11. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

ZenView makes no warranties that:

• The Service will be uninterrupted, secure, or error-free
• The AI detection will be 100% accurate
• The Software will meet your specific needs or expectations
• Any content will be successfully blocked
• Use of ZenView will achieve any particular outcome in your recovery journey

ZenView is a tool, not a cure. It is designed to support your recovery efforts but does not replace professional treatment, therapy, or personal commitment.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

12.1 Liability Cap

ZenView's total liability to you for any claims arising from or related to these Terms or your use of the Service shall not exceed the total amount you paid to ZenView in the 12 months preceding the claim.

12.2 Excluded Damages

ZenView shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Lost profits, data, or business opportunities
• Relationship damage or emotional distress
• System damage or data loss
• Costs of substitute services
• Any damages arising from use or inability to use the Service

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if ZenView has been advised of the possibility of such damages.

12.3 Acknowledgment

You acknowledge that the limitations in this section reflect a reasonable allocation of risk and that ZenView would not provide the Service at the current pricing without these limitations.

13. Indemnification

You agree to indemnify and hold harmless ZenView, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of ZenView
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

14. Termination

14.1 Termination by You

You may terminate your account at any time by canceling your subscription and uninstalling the Software.

14.2 Termination by ZenView

We may suspend or terminate your account immediately if:

• You breach these Terms
• You engage in fraudulent activity
• Your account remains inactive for more than 12 months
• We are required to do so by law
• We determine (in our sole discretion) that your use creates liability or harm

14.3 Effect of Termination

Upon termination:

• Your license to use ZenView ends immediately
• You must uninstall the Software from all devices
• You will not receive a refund for unused subscription time
• Certain provisions of these Terms (including liability limitations and indemnification) survive termination

15. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by:

• Posting the updated Terms with a new "Last Updated" date
• Sending email notification to your registered email address (for significant changes)

Continued use of ZenView after changes become effective constitutes acceptance of the updated Terms.

16. Intellectual Property

ZenView, including all software, algorithms, trademarks, logos, and content, is owned by ZenView and protected by copyright, trademark, and other intellectual property laws. You are granted only the limited license described in Section 3.

17. Third-Party Services

ZenView may integrate with third-party services (e.g., payment processors, analytics providers). Your use of these services is subject to their respective terms and privacy policies. ZenView is not responsible for third-party services.

18. Export Compliance

You may not export, re-export, or transfer the Software in violation of any applicable export control laws or regulations.

19. Dispute Resolution and Governing Law

19.1 Governing Law

These Terms are governed by the laws of Poland.

For EU Consumers: You retain all mandatory rights under applicable EU consumer protection laws, including but not limited to the EU Consumer Rights Directive. Nothing in these Terms limits your statutory rights as an EU consumer.

19.2 Dispute Resolution

For Non-EU Users: Any disputes arising from these Terms or your use of ZenView may be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if they qualify.

For EU Users: You have the right to bring disputes before the competent courts in your jurisdiction. EU consumers cannot be required to waive their right to court proceedings.

20. Miscellaneous

20.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ZenView.

20.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

20.3 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

20.4 Assignment

You may not assign or transfer these Terms or your account. ZenView may assign these Terms without restriction.

20.5 Force Majeure

ZenView is not liable for any failure to perform due to circumstances beyond our reasonable control.
